Mounter Fitness – Terms & Conditions

These Terms and Conditions apply to your purchase and use of Mounter Fitness services, including Personal Training sessions, consultations, online exercise programmes, exercise videos, memberships, subscriptions, the Mounter Fitness website and mobile app.

 

These Terms and Conditions form part of your agreement with Mounter Fitness and apply whether you purchase or access our services in person or online.

 

By purchasing a service, creating an account, starting a membership or accessing our online services, you confirm that you have read and agree to these Terms and Conditions.

 

1. Personal Training – Block Packages

 

All payments must be made in full, either in person, via BACS payment or through GoCardless.

 

Payment must be made in full before any Personal Training sessions are undertaken.

 

Please keep a note of the number of sessions you have remaining, as will your Personal Trainer.

 

All Personal Training block packages have a 120-day expiry period. Any unused sessions after this period will normally be lost and no refund will be provided.

 

Personal Training packages may be extended for between one and twelve full calendar months in the following circumstances:

 

- Pregnancy

- Serious illness

- Serious injury

- Redundancy

 

You must contact your Personal Trainer to request an extension. We may ask for reasonable evidence where appropriate.

 

Any other extension is at the discretion of Mounter Fitness.

 

2. Personal Training – Monthly Direct Debit

 

Direct debit is available for Personal Training package options through GoCardless.

 

Payment will be taken on the 1st day of each month.

 

All direct debit Personal Training sessions must be used within the calendar month to which they relate. Sessions not used within that calendar month will normally be lost and cannot be carried forward or refunded.

 

There is a three-month minimum commitment for direct debit Personal Training packages. Three full months must be completed before you are entitled to cancel the package, subject to any applicable legal cancellation rights.

 

To ensure your direct debit starts on the 1st day of the following month, you must have completed the agreement online or signed and returned this agreement by the 20th day of the current month.

 

Top-up sessions may be purchased at any time by clients who are on a direct debit Personal Training package. These are available at the reduced rate stated by your Personal Trainer.

 

3. Personal Training – Session Cancellations

 

A minimum of 24 hours' notice is required to cancel or rearrange a Personal Training session.

 

Cancellation should be made directly through your Personal Trainer.

 

If less than 24 hours' notice is provided, the session may be lost and no refund will normally be provided.

 

Any rearranged session will be at a time mutually agreed between you and your Personal Trainer.

 

4. Cancellation of Ongoing Personal Training

 

If you have completed the three-month minimum commitment for a direct debit Personal Training package and wish to stop your ongoing training, you must notify Mounter Fitness.

 

We recommend providing cancellation notice in writing by email.

 

If you wish to cancel or change your direct debit, you should notify Mounter Fitness before the 20th day of the month where possible.

 

5. Lateness

 

If your Personal Trainer is more than 10 minutes late for your session, you will be entitled to the remaining session time plus a complimentary session.

 

If you arrive late for your session, the session will be reduced accordingly.

 

If you are more than 25 minutes late, your Personal Trainer may choose to cancel the session. In this situation, the session may be treated as used and no refund will normally be provided.

 

6. Refunds

 

If you become medically unable to complete your remaining Personal Training sessions, Mounter Fitness may provide a refund for outstanding sessions where appropriate.

 

We may ask for reasonable evidence, such as confirmation from your GP or another appropriate healthcare professional.

 

Nothing in these Terms and Conditions affects your statutory consumer rights.

 

7. Online Memberships & Monthly Subscriptions

 

Mounter Fitness offers online memberships providing access to exercise videos, programmes, resources, the Mounter Fitness website, mobile app and, where included, our online community.

 

Online memberships are paid by monthly recurring payment.

 

When you purchase an online membership, you authorise the agreed monthly payment to be taken automatically until you cancel your membership.

 

The price of your membership will be clearly displayed before you purchase.

 

Your membership provides access to subscription-only content while your membership remains active and payments are up to date.

 

8. Online Membership – Cancellation

 

You may cancel your online membership within 7 days of your initial subscription by contacting Mounter Fitness at:

If you cancel within the first 7 days, we will refund your initial membership payment where applicable, subject to any legal requirements relating to digital content or services that have already been provided.

 

After the initial 7-day period, you may cancel your membership at any time.

 

Cancellation will stop future monthly payments, and your membership will normally remain active until the end of the current paid subscription period.

 

No refund will normally be provided for part of a monthly subscription period after the initial 7-day period, unless required by law.

 

Where digital content has been accessed immediately after purchase, your cancellation and refund rights may be affected where you have expressly agreed to immediate access and acknowledged the consequences of doing so.

Nothing in this section affects any statutory cancellation or refund rights you may have under UK consumer law.

 

9. Online Exercise Videos & Services

 

Online exercise is undertaken without your Personal Trainer being physically present.

 

You are responsible for choosing exercises and sessions that are appropriate for your own ability, health and circumstances.

 

Before exercising, you should make sure that:

 

- You have enough space to exercise safely.

- The area is free from trip hazards and other potential dangers.

- Any equipment you use is suitable and in good condition.

- You are wearing appropriate clothing and footwear.

- You have access to water where appropriate.

 

Please follow the instructions provided in each exercise video and work at a pace that feels comfortable for you.

 

You do not need to keep up with the instructor or complete every exercise.

 

You should stop exercising immediately if you experience pain, dizziness, feeling faint, unusual shortness of breath or feel unwell in any way.

 

If you are concerned about your health or symptoms, seek appropriate medical advice.

 

10. Health Information & Exercise Safety

 

You are required to provide accurate and up-to-date information about your health before undertaking Personal Training or appropriate online exercise services.

 

This includes informing Mounter Fitness of any new or existing medical conditions, injuries, changes in medication or other circumstances that could affect your ability to exercise safely.

 

You may be asked to complete a Physical Activity Readiness Questionnaire (PAR-Q) and/or an initial health and exercise questionnaire.

 

Your Personal Trainer may request medical clearance from your GP or another healthcare professional where appropriate.

 

You understand that your GP or healthcare professional may charge you for providing medical clearance.

 

Completing a PAR-Q or health questionnaire does not replace medical advice.

 

Mounter Fitness cannot diagnose medical conditions or prescribe medical treatment. Where appropriate, you may be advised to seek advice from your GP or another healthcare professional before exercising.

 

11. Online Exercise & Individual Needs

 

Mounter Fitness aims to provide exercise options suitable for a range of abilities and fitness levels, including seated and lower-impact alternatives where appropriate.

 

However, online exercise content cannot account for every individual's health, physical ability or circumstances.

 

If you are unsure whether an exercise or session is suitable for you, please contact Mounter Fitness before participating.

 

You are encouraged to modify, skip or stop any exercise that does not feel appropriate for you.

 

12. Health & Safety – Personal Training

 

Your Personal Trainer holds an appropriate emergency first aid qualification and has £5 million public liability insurance cover.

 

If your Personal Trainer conducts a session on your premises, you are responsible for providing a reasonably safe exercise environment.

 

You are required to wear appropriate clothing and footwear and to follow reasonable instructions provided by your Personal Trainer.

 

There are inherent risks associated with physical exercise. While Mounter Fitness takes reasonable steps to provide safe and appropriate exercise, you participate in exercise at your own level and should inform your Personal Trainer of anything that may affect your ability to exercise safely.

 

Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful.

 

13. Your Responsibilities

 

You agree to:

 

- Provide accurate information about your health and circumstances.

- Inform Mounter Fitness of any relevant changes to your health.

- Follow reasonable exercise and safety instructions.

- Arrive on time for Personal Training sessions.

- Wear appropriate clothing and footwear.

- Treat Mounter Fitness staff and other members respectfully.

- Use your online membership and account responsibly.

- Keep your login details secure.

 

14. Online Community

 

Where your membership includes access to an online community, you agree to communicate respectfully with other members.

 

You must not post or share content that is abusive, threatening, discriminatory, offensive, misleading or otherwise inappropriate.

 

Please do not share personal or sensitive health information in community posts or messages, as anything posted in a community area may be visible to other members.

 

Mounter Fitness reserves the right to remove inappropriate content or restrict access to the community where necessary.

 

15. Account & Membership Access

 

Online membership accounts are personal to the member and must not be shared.

 

You must not allow another person to use your account or access subscription-only content using your login details.

 

Mounter Fitness may suspend or terminate access where there has been misuse of an account, unauthorised sharing of content, non-payment or a serious breach of these Terms and Conditions.

 

16. Online Content & Intellectual Property

 

All exercise videos, programmes, written materials, photographs, graphics and other content provided by Mounter Fitness remain the property of Mounter Fitness or the relevant content owner.

 

Your membership gives you permission to use this content for your own personal, non-commercial use.

 

You must not copy, reproduce, download, distribute, sell, share or commercially use Mounter Fitness content without prior written permission.

 

17. Website & App Availability

 

Mounter Fitness will make reasonable efforts to keep the website, app and online services available.

 

However, we cannot guarantee that they will always be available without interruption.

 

Access may occasionally be affected by maintenance, technical issues, internet connection problems or circumstances outside our reasonable control.

 

You are responsible for having a suitable device and internet connection to access the online services.

 

Mounter Fitness may update or change online content, videos, programmes, features or resources from time to time.

 

18. Refunds & Statutory Rights

 

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

 

Where a refund or cancellation is required by applicable UK consumer law, Mounter Fitness will comply with those requirements.

 

19. Privacy

 

Mounter Fitness collects and uses personal information in accordance with our Privacy Policy, which is available on our website.

 

By using our services, you acknowledge that your personal information will be handled in accordance with our Privacy Policy.

 

20. Changes to These Terms

 

Mounter Fitness may update these Terms and Conditions from time to time to reflect changes to our services, memberships, online content or legal requirements.

 

Where appropriate, we will provide reasonable notice of significant changes.

 

The latest version will be available on the Mounter Fitness website.
